This privacy policy applies only to this website operated and maintained by Purple Eternity Records (referred to as “we” or “us”) where this privacy policy is posted (collectively, the “Site”). This privacy policy does not pertain to information that is collected offline. By using this Site, you consent to the terms and conditions of this Privacy Policy and to our processing of personal information for the purposes stated below. If you do not agree to the terms and conditions of this privacy policy, please do not use the Site.

A. Information Collected

This privacy policy applies only to information collected on the Site and does not apply to information collected by us through any other means. We collect the information you provide to us actively, and also collect information automatically from the devices that interact with our Site, as explained below.

(1) Information You Actively Provide

We collect personal information, such as your name and E-Mail address that you actively provide to us when you communicate with us through this Site, by a direct message via our contact form. Both may also contain information about your gender, company name, or any other personal information or data that may be included in your name or E-Mail address. This additional information and data is not going to be processed by us in any way. We are also collecting personal information with your subscription to our newsletter, where you are only providing your E-Mail address to us (that again, may include additional personal information as stated above), which will be stored for purposes such as providing you with our promotion of upcoming releases, events, and more.

We receive and store the information that you enter on our Site or give to us in any other way. The above list provides an example of the personally identifiable information that may be collected on the Site. If you do not want us to collect your personally identifiable information, please do not provide it to us.

Soundcloud – We use Soundcloud for the streaming of audio content on our Site, with the cookies providing functions across pages and storing language settings. The cookie that provides funtions across our pages is retained for 10 years (more info via cookiedatabase.org), while the cookie that stores the language settings is retained for 1 year (more info via cookiedatabase.org). Facebook – We embed our Instagram feed on our Site. The cookie placed by Facebook is managing the ad display frequency, and is in general used for marketing and tracking purposes. It is retained for 1 year, for more information please visit cookiedatabase.org.

E. Children

The features, promotions and other aspects of this Site requiring personally identifiable information are not intended for children. We do not knowingly collect personally identifiable information from children under the age of sixteen (16) in the European Union, or the age of thirteen (13) in the United States of America and the rest of the world. G. E-Mail Opt-Out

However, we provide you the opportunity to exercise an opt-out choice if you do not want to receive any types of communication from us, such as E-Mails or updates from us regarding new releases, services and products offered on this Site, or if you do not want us to share your personally identifiable information with third parties. The opt-out choice may be exercised by sending us a message to newsletter@purpleeternityrecords.com with the subject “Cancellation of the Newsletter”, which will lead to the deletion of your E-Mail address from our mailing list. We will process your unsubscribe as soon as possible, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed. To process your request as fast as possible, we ask you to enter the exact same subject for the E-Mail to unsubscribe from the newsletter as stated above (subject: “Cancellation of the Newsletter”).

I. Assignment

In the event that all or part of our property and assets are changing ownership, you grant us the right to assign the personally identifiable and non-personally identifiable information collected via the Site.

We reserve the right to change this privacy policy from time to time. When we do, we will also revise the date of publishing of this privacy policy. DATA PROCESSING AGREEMENT

Under GDPR, data controllers are obligated to enter into a written “data processing agreement” with service providers (known as processors) engaged to process data on its behalf, in order to evidence that the processor will operate in compliance with GDPR. However, data processing agreements do not apply to the relationship between Purple Eternity Records and its visitors, since visitors do not process data on behalf of Purple Eternity Records.

USE OF EMBEDDED PLAYERS AND WIDGETS THAT EMBED SOCIAL MEDIA APPS

We are using embedded players from Soundcloud and Vimeo to make our content, which we exclusively upload on these platforms for streaming, also available on our Site. The use of these embedded players is subject to the Terms of Use and the Privacy Policy of the respective website (either Soundcloud or/and Vimeo), as they may collect usage data for their purposes of analytics.
